Case summary

On May 22, 2018, a Consent Agreement and Final Order ( CAFO ) was entered by the Environmental Appeals Board ordering Maryland Performance Diesel, LLC ( MPD ) to comply with all terms of a Consent Agreement and Final Order ( CAFO ). MPD signed the CAFO on April 10, 2018 to settle violations of the Clean Air Act ( CAA ). MPD operates a diesel truck service and performance upgrade sales and installation facility. MPD manufactured and/or sold performance tuners, tunes, exhaust gas recirculation delete kits, and exhaust emission control device replacement pipes that have the effect of altering the engine?s fueling strategy, or mechanically bypassing vehicle emission controls. The installation and sale of these types of devices is prohibited by CAA section 203(a)(3)(B). Under the agreement, MPD will pay a civil penalty of $45,000 and implement a compliance plan that requires them to cease and refrain from purchasing, selling, or installing any defeat devices and from tampering with emission control systems on EPA-certified motor vehicles and motor vehicle engines.
