Case summary
On September 27, 2018 Region 3 issued a Notice of Warning (NOW) to CDG Environmental, LLC (CDG) of Allentown, PA and a NOW to ChemTreat, Inc. (ChemTreat) of Glen Allen, VA in connection with sales and distribution of a misbranded pesticide. The misbranded pesticide is produced by CDG, and labeled and distributed by CDG with ChemTreat's provided label. The label in question is mostly illegible making it impossible for users to clearly read information such as the precautionary statements and directions for use. ChemTreat is a supplemental distributor of CDG's, and thus both the registrant and distributor are liable for violations pertaining to the distributor product. The NOW requires both CDG and ChemTreat to come into compliance with FIFRA by using a fully compliant (legible) label.
