Case summary
On August 29, 2018, Region III issued a FIFRA Notice of Warning (NOW) to Folia Water, Inc. Folia ) formerly of Pittsburgh, PA and now located in New York, NY in connection with sales and distributions of a unregistered pesticide the Safe Water Book or Folia Filters. The filters, impregnated with silver, claim to use silver ions to kill bacteria and make harmful water safe to drink. These claims, which imply that the filters can be used as a pesticide, are unlawful because the filters have not been registered by the EPA. Since the filters have not undergone the extensive registration process under FIFRA, they may not be effective and could be harmful to users. The NOW requires Folia to respond within 10 days explaining how they plan to come into compliance with FIFRA, specifically indicate what measures they will take to ensure unregistered pesticides are not distributed in the United States.
