Case summary

On March 8, 2018 Region 3 issued a Notice of Warning (NOW) to Auto-Chlor System of Baltimore (Auto-Chlor) of Rosedale, MD in connection with sales and distribution of a sanitizer pesticide from their EPA-registered Rosedale, MD pesticide production facility. The pesticide was misbranded because multiple net contents were listed without any obvious markings to indicate the actual net contents of the container. The net contents of a container for sale and distribution are required to be on the label per regulations. If a producer lists multiple net contents, the actual net contents must be clearly marked or highlighted, for example, with an arrow, a notch, a bullet, etc. The NOW requires Auto-Chlor to come into compliance with FIFRA.
