Case summary
On December 18, 2018, a Notice of Warning (NOW) was sent to EOS Surfaces, LLC of Norfolk, VA for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). Under FIFRA, before any company can sell or distribute a pesticide, they must submit a copy of the product's label to EPA to verify that all required information is present and accurate, including the directions for use, signal word, first aid instructions, precautionary statements, disposal instructions, product name, company name, and associated identifiers. Once this label is Accepted , all products sold under this name must have an identical label to the EPA Accepted label. EOS Surfaces a product called Antimicrobial Cupron Enhanced EOS Surface that contained hanging label with missing precautionary statements and directions for use. This is considered a misbranded pesticide and is a violation of FIFRA. Under the NOW, the company must bring their label into compliance.
