Case summary

]. On September 6, 2018, Region III filed a Consent Agreement and Final Order (CAFO) which simultaneously commenced and resolved an administrative enforcement action against Vesuvius, Inc. for its violations of the Commonwealth of Virginia?s federally authorized underground storage tank (UST) program with regards to the four (4) USTs it owns and are located at the Lee Hi Travel Plaza in Lexington, Virginia . The prevention and detection of leaks are the cornerstones of the UST regulatory program. The testing of tanks annually assures that such are operational and helps to prevent catastrophic releases. The CAFO resolves the failure by Vesuvius to conduct tank release detection for two (2) of these tanks and failure to maintain records of release detection for all four (4) tanks. Under the terms of the SCAFO, Vesuvius has agreed to pay a civil penalty of $14,000.00. The Commonwealth of Virginia was notified of this action.
