Case summary

On August 2, 2018, EPA Region III filed a Consent Agreement and Final Order simultaneously commencing and settling an administrative action alleging certain violations of the Section 1018 Lead Disclosure Rule by Mr. Sean and Mrs. Marcy McCann (Respondents) with respect to Respondents ownership and leasing of pre-1978 housing (Target Housing) in Williamsport, Pennsylvania. By this action, EPA hopes to ensure that landlords provide tenants with information necessary to prevent childhood lead poisoning in homes that may contain lead-based paint or lead-based paint hazards. Respondents allegedly failed to include, as attachment too or within the contract: (1) the lead warning statement; (2) statement disclosing the presence of known lead-based paint or indicating no knowledge of the presence of lead-based paint or hazards; (3) statement affirming receipt of required information; and (4) the signatures certifying accuracy of statements with dates. Under the terms of the CAFO, Respondent will pay a penalty of $2,303.
