Case summary
On February 22, 2017, the RJO signed the Final Order accepting the Consent Agreement (collectively ACAFO@) negotiated in settlement of certain violations by Buckman Laboratories, Inc. (Respondent) with respect to the sale or distribution of a misbranded pesticide. Specifically, the CAFO addresses the sale or distribution of a misbranded pesticides, Buckman DIALD 45 (EPA Reg. No. 1448-421), Buckman DIALD 25 (EPA Reg. No. 1448-422), Buckman DIALD 15 (EPA Reg. No. 1448-432), and Buckman DIALD 50 (EPA Reg. No. 1448-427), EPA has established standards for pesticide lables to include statements identifying the container as refillable or non-refillable, and instructions for proper disposal or recycling of containers to protect human health and the environment. Respondent's labels for did not comply with the requirements. Under the terms of the CAFO, Respondent will pay a civil penalty in the amount of $160,000. This matter arose of an inspection of a Dow Chemical facility in West Virginia that manufactured pesticides on behalf of Respondent, and to which Respondent provided the noncomplying labels. The Respondent is located in Memphis, TN. Therefore, Region 4 was notified and concurred with this action.
