On October 17, 2017, an authorized representative of the EPA conducted an inspection of the Bethlehem Energy Center facility located at 2254 Applebutter Road in Bethlehem, PA, to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically: (1) The owner/operator failed to perform inspections and tests on process equipment in accordance with 40 C.F.R. 68.73(d)(1 ). Ammonia piping was not inspected in accordance with industry standards. (2) The facility failed to evaluate compliance with the provisions of the prevention program at least every three years to verify that the developed procedures and practices are adequate and being followed.
