Case summary

On April 17, 2018, Region III entered into a Consent Agreement with, and issued a Final Order to, Fort Dearborn Company, settling violations of RCRA Subtitle C that EPA inspectors observed during an inspection of the company's facility in Tyrone, Pennsylvania (Facility). The settlement will ensure that, in the future, the company will properly manage hazardous and universal waste at the Facility, as well as properly comply with reporting and emergency planning requirements. At the Facility, the company manufactures and prints roll labels for the beverage industry. RCRA is designed to protect human health and the environment by providing for the safe management of such hazardous wastes. The Company has agreed to pay a penalty of $40,000 to settle the enforcement action. During the inspection of the Facility, EPA was accompanied by an inspector from the Pennsylvania Department of Environmental Protection (PaDEP). EPA further informed PaDEP of the action by letter on March 7, 2017, and received no objection.
