Case summary

On February 9, 2018, Region III entered into a Consent Agreement with, and issued a Final Order to, Blue Ridge Solvents & Coatings, Inc., settling violations of RCRA Subtitle C that EPA inspectors observed during an inspection of the company's facility in Henry, Virginia (Facility). The settlement will ensure that, in the future, the company will properly contain and manage hazardous waste at the Facility, and ship it offsite in a timely manner. At the Facility, the company manufactures a variety of custom paints and coatings, as well as conducts re-blending, recovery, and redistribution of solvents and other chemicals. Because these processes generate a variety of hazardous wastes, the Facility is required to comply with the Resource Conservation and Recovery Act (RCRA) and the federally-authorized Virginia Hazardous Waste Management Regulations (VHWMR). RCRA is designed to protect human health and the environment by providing for the safe management of such hazardous wastes. During the inspection of the Facility, and through subsequent communications, the EPA inspectors observed that the company: (1) operated a hazardous waste treatment, storage, and disposal facility without a permit or interim status, and stored hazardous waste for greater than 90 days; (2) failed to make a hazardous waste determination on hundreds of containers of outdated epoxy and coatings; (3) failed to keep hazardous containers closed except when it is necessary to add or remove waste; and (4) failed to maintain signed manifests or file exception reports. The Company has agreed to pay a penalty of $35,000 to settle the enforcement action. The Consent Agreement and Final Order initiate and resolve this enforcement action. During the inspection of the Facility, EPA was accompanied by three inspectors from the Virginia Department of Environmental Quality ( VADEQ ). EPA informed VADEQ of the action by letter on February 8, 2017, and received no objection.
