Case summary
On October 5, 2017, EPA inspectors conducted an inspection of the Gordon Food Service facility located at 504 Advantage Way, Aberdeen, MD. to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically, the facility failed to: (1) use the appropriate wind speed and stability class for worst-case release calculation (68.22 {b)] and, (2) ensure the process equipment complies with recognized and generally accepted good engineering practices {RAGAGEPs) [68.65(d)(2)]. In this case, the evaporators in the loading dock and refrigerated spaces were not provided with adequate protection from physical damage.
