Final Order With Penalty
Case summary
Region III Files Consent Agreement/Final Order Settling Lead Disclosure Rule Violations by Rentlhousn4U LLC of Petersburg, Virginia. On January 31, 2018, EPA Region III, filed a Consent Agreement and Final Order simultaneously commencing and settling an administrative action against Rentlhousn4U LLC (Respondent) for allegedly violating Section 1018 of the Residential Lead-Based Paint Hazard Reduction Act of 1992 (Act) and the Disclosure Rule, 40 C.F.R. Part 745, Subpart F. The Act was enacted to address concerns about the prevalence of lead poisoning among American children and resulting serious health effects. The Disclosure Rule promotes public health by requiring disclosure of lead-based paint and/or lead-based paint hazards in pre-1978 (target) housing offered for sale or lease. This case was initiated as a result of a tip referred to EPA by the Virginia Department of Health regarding a child with an elevated blood lead level. The Virginia Department of Labor and Industry was notified of this impending action and has not objected. Respondent owns and leases numerous properties in Petersburg, Virginia. Respondent allegedly violated the Disclosure Rule by failing to include as an attachment to or within each of two contracts to lease target housing: (1) the Lead Warning Statement ; (2) a statement by the lessee affirming receipt of, among other things, EPA's lead hazard pamphlet; and (3) a statement by Respondent as lessor disclosing the presence of known lead-based paint and/or lead-based paint hazards or indicating no knowledge of any such paint/hazards. Pursuant to the CAFO Respondent will pay a civil penalty of $24,633 in settlement. This amount reflects Respondent's ability to pay/to continue to do business and other factors.
