Case summary
This matter requires the performance of actions to ensure the mitigation or prevention of a substantial threat of a discharge of oil from an oil storage facility in Laurel, Delaware. On October 25, 2017, EPA filed an Administrative Order on Consent ( Consent Order ), which it entered into with Compass Energy, Inc.( Compass Energy ), the owner and operator of an HV AC sale and repair and oil storage company, which includes a 24,000-gallon above-ground heating oil storage tank, an 18,000-gallon above-ground kerosene oil storage tank, an 8,000-gallon above-ground empty storage tank, and a loading and unloading docks, located at the intersection of I 0th Street and Wolfe Street in Laurel, Delaware. The Consent Order, which becomes effective upon Respondent's receipt of a fully executed copy, provides that, within a specified time frame, Compass Energy will contract with a professional engineer to evaluate the Facility and commence work at its facility to address alleged violations of CW A 31 l (j) and the corresponding SPCC Regulations, including, but not limited to, preparing and implementing an SPCC plan, training oil-handling personnel, constructing or repairing secondary containment that is sufficiently large and impervious to contain discharged oil, and having a qualified individual test each aboveground container for integrity. on a regular schedule, as defined by industry standards. DNREC was invited to participate in EPA's joint SPCC/EPCRA inspection and is in support of an enforcement action.
