Case summary

On November 7, 2017, EPA Region III and the Borough of Camp Hill, Pennsylvania, amicably resolved alleged Clean Water Act violations of the Borough's MS4 Permit, which is significant due to the myriad of pollutants conveyed by stormwater and therefore affecting both human health and the environment. To resolve the matter, EPA Region III and the Borough entered into a Super Consent Agreement and Final Order (SCAFO) and an Administrative Order for Compliance on Consent (AOCC). The Super CAFO requires the Borough to pay a monetary penalty of nineteen thousand dollars ($19,000). The AOCC requires the Borough to take specific actions to remedy the issues raised by the inspection, including: (1) development of a written program for inspection of post-construction stormwater BMPs; (2) development of a written program for inspection of municipal stormwater BMPs; (3) submission of the results of an audit of all municipal facilities; and (4) various actions regarding training and certification of stormwater compliance staff. EPA notified the Pennsylvania Department of Environmental Protection of this enforcement action in May 2016.
