EPA v. NUPRO INDUSTRIES CORPORATION
Final Order With Penalty
Case summary
On September 25, 2017, EPA Region III filed an EPCRA Section 313 administrative Consent Agreement and Final Order which simultaneously commenced and resolved two EPCRA Section 313 violations alleged against Nupro Industries Corp. ( Nupro ), of 2925 E. Ontario Street Philadelphia, PA 19134. Nupro operates a fats and oils refining facility. On two occasions, Nupro failed to report the use or processing of Methanol to EPA, PADEP, and the local fire chief. Complying with EPCRA helps increase the public's knowledge and access to information on chemicals at individual facilities, their uses, and releases into the environment as well as aid first responders in the event of a release or fire at the facility. States and communities, working with facilities, can use the information to improve chemical safety and protect public health and the environment. EPA consulted with the Pennsylvania Department of Environmental Protection, which expressed no objection. Pursuant to the consent agreement, Nupro will pay a civil penalty of $9,930.00.
