Case summary

On July 10, 2017, the Acting Director of the Air Protection Division signed an administrative order by consent with Felman Production, LLC (Felman) to address alleged violations of provisions of the Ferroalloy MACT regulating manganese and other air pollutants identified as being hazardous to human health or the environment emitted as fugitives at Felman's silicomanganese production facility located at 4442 Graham Station Road in Letart, West Virginia. The Order requires Felman to install and operate a roofline ventilation system in the Facility's shop building; prepare, submit and operate pursuant to a shop building process fugitive ventilation fugitive ventilation plan; make improvements to increase the capture of fugitive emissions associated with Furnace No.2 operations, and to demonstrate compliance with the emissions standards for process fugitive emissions set forth in the Ferroalloy MACT by June 30, 2018. Though unable to enter into an agreement with Felman since it has not received delegation of the Ferroalloy MACT at issue, West Virginia is aware of Felman's compliance issues, has been informed of this action and has raised no objection.
