Case summary
On April 11, 2017, authorized representatives of the EPA conducted an inspection of the subject facility to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act by failing to comply with the regulations namely: 1. FaiIure of the owner or operator to develop a management system to oversee the implementation of the risk management program elements in accordance with 40 C.F.R. 68.15(a) . 2. Failure of the owner or operator to certify annually that their SOP's are current and accurate and that procedures have been reviewed as often as necessary in accordance with 40 C.F.R. 68.69(c). 3. Failure of the owner or operator to promptly determine and document an appropriate response to each of the findings of the audit and document that deficiencies had been corrected in accordance with 40 C.F.R. 68.79( d). 4. Failure of the owner or operator to have a written plan for employee participation in accordance with 40 C.F.R. 68.83(a).
