EPA, Region 3 has commenced and resolved a Class 1 Administrative Penalty action against Superior Concrete Materials, Inc., ( Superior ) as a result of unpermitted discharges during a period of permit lapse. Superior, located in Washington, D.C. had been previously covered by the MultiSector General Permit ( MSGP ), but had allowed its permit coverage to lapse. During the period of lapse, Superior experienced numerous discharges to the Anacostia River, a water of the United States. The parties agreed to resolve this matter for a settlement of $20,000
