Case summary
Division Director Issues Consent Agreement and Final Order that Includes Next Gen Compliance, EPA Docket No. CWA-03-2017-0055, and Administrative Order on Consent, Docket No. CWA-03-2017-0056DW, In The Matter of City of Havre De Grace. On February 13, 2017, the Acting Division Director of the Water Protection Division issued a Consent Agreement and Final Order, Docket No. CWA-03-2017-0055, and an Administrative Order on Consent, Docket No. CWA-03-2017-0056DW Docket No. CWA-03-2017-0056DW, to City of Havre de Grace for violations of its MS4 Permit, General Permit No. 12-SW for Discharges from Stormwater associated with Industrial Activities for the City?s Department of Public Works facility. Under its Permit, Respondent failed to: 1) map the extent of the storm drain system and cure the discrepancies between the GIS map and the actual location of some of the sewer outfalls; 2) develop procedures for field screening storm drain outfalls on a consistent basis; 3) develop inspection procedures for identifying the source of any suspected illicit discharges to the storm drain system; 4) develop enforcement and penalty procedures and post them to the City?s website; and 5) ensure that non-stormwater discharges to the MS4 were either permitted by MDE under NPDES or eliminated. In addition, Respondent failed to implement and maintain pollution prevention and good housekeeping techniques and procedures at City operations by: 1) failing to provide employee training materials to prevent and reduce pollutant discharges to the storm drain; 2) failing to provide runoff controls geared toward fleet yard and building maintenance activities; and 3) failing to ensure all facility activities were properly permitted under NPDES Industrial General Permit (02-SW) or any other appropriate State or Federal water pollution control program. Respondent agreed to pay a penalty in the amount of $13,800 in settlement of the matter. In addition, Respondent has agreed to perform a Supplemental Environmental Project to convert a failed sedimentation pond into a working storm water control. In addition, the pond will become a living science laboratory for a local high school which includes water quality monitoring of the facility. Further, the City of Havre de Grace will provide real time reporting of the monitoring results in keeping with the Next Gen Policy.
