Case summary
On August 9, 2016 the Regional Judicial Officer ratified a combined Complaint and Consent Agreement between EPA Region III and Cytec Engineered Materials Inc. (Cytec) in settlement of RCRA Subtitle C regulatory violations at the Cytec's specialty bonding adhesive and composite material production facility located in Havre de Grace, Maryland (the Facility). During the course of an August 7-8, 2013 compliance evaluation inspection of the Facility, EPA identified violations of RCRA Subtitle C and of the federally-authorized Maryland Hazardous Waste Management Regulations that included the operation of a hazardous waste storage facility without a permit or interim status and the failure to: (a) include certain required information in the Facility's Contingency Plan and to therein indicate whether copies the current Facility Contingency Plan had been submitted to all local police departments, fire departments, hospitals, contractors, and State and local emergency response teams, as required; (b) mark five containers of hazardous waste so that the beginning period of waste accumulation in each container was visible for inspection; (c) properly mark a container of hazardous waste with the correct date on which the period of less than 90-day accumulation began; (d) properly label or mark stored individual and containerized universal waste batteries being stored at the Facility; and (e) properly indicate the length of time that universal waste batteries had been accumulated at the Facility from the date that they became waste. Cytec cooperated fully with EPA during its inspection and investigation and has certified that the Facility now is in compliance with all relevant provisions of RCRA. The settlement requires the Company to pay a $15,000.00 civil penalty for the identified violations.
