On January 21. 2016, approximately 4,200 gallons of diesel fuel were discharged from Respondent's emergency power generator systemat its facility located at 2400 Market Street, Philadelphia, PA. into the Schuylkill River, a navigable water of the United States. The discharge caused pockets of diesel fuel along the tidal wall and a sheen along the surface of the Schuylkill River, in violation of the Clean Water Act, Section 311(b)(3).
