On November 19. 2015 an authorized representative or the EPA conducted an inspection or the MarkWest Houston Gas Plant facility located at 800 Western Ave in Washington. PA, to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) or the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act. specifically: (1) Failure of the owner or operator who experienced an accidental release that met the five-year accident history reporting criteria (as described at 68.42) subsequent to April 9. 2004. The owner or operator did not submit the information required at 68.168. 68.1700) and 68.175(1) within six months of the release or by the time the RMP was updated as required at 68.190, whichever was earlier.
