Case summary
On March 9, 2016, EPA inspectors conducted an inspection of Novipax, LLC. Reading, Pennsylvania ( Facility ) to determine compliance with the Risk Management Program ( RMP ), Clean Air Act 112(r)(7) and the Implementing regulations of 40 CFR Part 68. The Facility converts hard polystyrene resin pellets into soft foam sheet and then into tray type-containers for the food industry. The facility utilizes n-pentane, an RMP regulated substance. in its manufacturing process. N-pentane is stored in two underground tanks with total capacity of 208,000 pounds. Based on the inspection, it was found that the Facility failed to certify annually that operating procedures are current an accurate (40 CFR Part 68.69(c)] and perform inspections and tests of process equipment (40 CFR Part 68.73(d)(3)].
