Case summary

On June 28, 2016, Region III filed a Consent Agreement and Final Order settling violations of Section 313 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA), 42 U.S.C. ? 11023, by General Dynamics ? OTS Pennsylvania, Inc. (Respondent) at its manufacturing facility located 200 East High Street, Red Lion, Pennsylvania, 17356 (Facility). During calendar years 2011 through 2013, the Facility processed lead as part of its operations in the fabrication of metal products. During calendar year 2013, the Facility also processed nickel and chromium as part of its operations in the fabrication of metal products. This CAFO resolves violations discovered by EPA during a December 8, 2014 inspection. In reviewing the Facility?s processing records, the inspector determined that Respondent had processed more than 100 pounds of lead in calendar years 2011 through 2013, more than 25,000 pounds of nickel in calendar year 2013, and more than 25,000 pounds of chromium in calendar year 2013 without timely filing a Form R or Form A with both EPA and the Commonwealth of Pennsylvania as required by Section 313 of EPCRA and the associated federal regulations of 40 C.F.R. Part 372. Under the terms of the settlement, Respondent will pay a civil penalty in the amount of $84,280.00 to resolve these violations.
