Case summary

The Regional Judicial Officer issued a Final Order on May 18, 2016, accepting the Consent Agreement to commence and settle a violation of CAA Section 112(r)(1), the General Duty Clause, in connection with a fluid milk manufacturing facility owned and operated by Galliker Dairy Company, and located at 143 Donald Lane in Johnstown, Pennsylvania. EPA conducted an inspection of the facility on July 29, 2015, and determined that Galliker Dairy had not designed and maintained its anhydrous ammonia refrigeration system to provide safety consistent with applicable industry codes. In particular, Galliker needed to conduct inspections and tests of the system, reset and update alarms, install signage, provide personal protective equipment, conduct training, and protect evaporators from forklift impacts. Galliker Dairy has corrected all of the identified conditions at the Facility. In settlement, Galliker Dairy has agreed to pay a cash penalty of $35,991.
