EPA v. READING, CITY OF (FRITZ ISLAND WASTE WATER TREATMENT PLANT)

Case summary

On October 22, 2015, an authorized representative of the EPA conducted an inspection of the Facility to determine compliance with the Risk Management Plan (RMP) regulations promulgated at 40 C.F.R. Part 68 under Section 112(r) of the Clean Air Act (the Act or CAA). EPA found that the Respondent had violated regulations implementing Section 112(r) of the Act, specifically: (1) The owner/operator failed to maintain information regarding codes and standards used to design, build and operate the covered process. (40 CFR 68.48(a)(5)], (2) The owner/operator failed to ensure the covered process was designed in compliance with recognized and generally accepted good engineering practices. [40 CFR 68.48(b)], (3) The owner/operator failed to provide employee-operators refresher training at least every 3 years related to the covered process. [40 CFR 68.54(b}J, (4) The owner/operator failed to perform inspection and testing on process equipment in accordance with recognized and generally accepted good engineering practices. [40 CFR 68.56(d)]. (5) The owner/operator failed to perform compliance audits at least every three years. [40 CFR 68.58], (6) The owner/operator failed to timely submit an Risk Management Plan correction within one month of a change in emergency contact information. [40 CFR 68.195(b)].
