The specific provisions alleged to have been violated include: failure to include information required by 45 W. Va. C.S.R. ? 13-5.4 in WVSIP operating permit applications; failure to create and maintain records of fuel use for each compressor engine; failure to conduct visible emissions checks and/or opacity monitoring and failure to retain or have available the required records of such checks and monitoring; failure to retain or have available the required records of fuel use; failure to monitor the presence or absence of a flare pilot flame to ensure that the Facility?s flare is operated with a flame present at all times whenever emissions may be vented; failure to timely apply for a Title V operating permit; failure to equip open ended lines with the required cap, blind flange, plug, or a second valve; failure to monitor valves in gas vapor or light liquid service at least quarterly; and failure to re-monitor leaking valves on at least two successive months. The civil penalty assessed in the CAFO is one hundred forty thousand dollars.
