Case summary
On April 21, 2016, EPA Region III filed a signed Consent Agreement and Final Order (CAFO) resolving an action against Ice Zone, Inc. (Ice Zone) for an alleged violation of Section 103 of CERCLA, and Section 304 and 312 of EPCRA, in connection with a facility located in Woodbridge Virginia. EPA alleges that Ice Zone, Inc. failed to: (1) immediately report a release of more than a reportable quantity of anhydrous ammonia from its facility located at 5180 Dale Boulevard, Woodbridge, Virginia (Facility) to the National Response Center (NRC) and the State Emergency Planning Commission (SERC); (2) submit a written follow-up report to the SERC and the Local Emergency Planning Committee (LEPC) as soon as possible following the release; and (3) submit to the SERC, LEPC, and local fire department a complete and accurate Hazardous Chemical Inventory Form for calendar years 2011 through 2013. The agreement requires Respondent to pay $33,000.00 in civil penalties.
