EPA v. PPG INDUSTRIES, INC. (2 FACILITIES)

Case summary

On March 31, 2016, Region III entered into a Consent Agreement with, and issued a Final Order to PPG Industries, Inc., settling violations of RCRA Subtitle C that EPA inspectors observed during an inspections of the company's coatings manufacturing and research facilities in Springdale, Pennsylvania ( Facilities ). Respondent's Paint Plant produces automobile original equipment manufacturer ( OEM ) coatings; general industrial and clear coatings; coil and extrusion products for windows, appliances and vinyl siding; and inks and paints for consumer electronics and electromagnetic coatings used as adhesives in cell phones. Respondent's Development Center was created to perform research and development in support of the Paint Plant and PPG plants located elsewhere. During the inspection, and through subsequent communications, the EPA Inspector observed that the Facility: (1) operated two hazardous waste storage facilities without a permit or interim status; (2) failed to keep copies of two manifests signed by the destination facilities; (3) failed to have required content (i.e. home addresses for emergency coordinators) in the Contingency Plan for the two Facilities; (4) failed to keep containers of hazardous waste closed during storage; and (5) failed to properly manage universal waste. The Company has agreed to pay a penalty of $59,000.00 to settle the enforcement action. The Consent Agreement and Final Order initiate and resolve this enforcement action.
