Case summary

The Regional Judicial Officer issued a Final Order on March 30, 2016, accepting the Consent Agreement to commence and settle violations of EPCRA Section 312 and the CAA Section 112(r)(1), in connection with a compressor station owned and operated by Eureka Hunter Pipelines, LLC, and located at 1 Union Carbide Road in Hastings, West Virginia. Eureka Hunter Pipelines failed to timely submit emergency and hazardous chemical inventory forms (Tier 2s) to the state, county, and local reporting entities for two hazardous chemicals it was storing on-site from 2013 to 2014. In addition, Eureka Hunter failed to ensure adequate emergency ventilation for the ten 664-barrel aboveground storage tanks holding condensate, an extremely hazardous substance. Eureka Hunter is in the process of completing improvements at the compressor station to add sufficient emergency ventilation for the storage tanks. In settlement, Eureka Hunter has agreed to pay a cash penalty of $38,847.
