Region 3 NPDES Inspection Team identified erosion and sediment control issues on the Monroe Street Markets site A1 and A2 in Washington DC during a compliance inspection on February 19, 2013. South Brookland Campus, LLC & Bozzuto Development Company (Respondents) are partners in the joint-venture for the construction activity. Subsequent reviews of the USEPA NPDES Inspection Report for Monroe Street Markets, 2012 Construction General Permit (CGP), Stormwater Pollution Prevention Plan (SWPPP) , Erosion and Sediment Control Plans, and self-inspection records resulted in non-compliant determinations. Examples of non-compliance include: 1) failure to post notice of NPDES Permit Coverage, 2) failure to install erosion and sediment controls, 3) failure to maintain erosion and sediment controls, 4)failure to minimize the track-out of sediment from vehicles exiting the site; 5) failure to control discharges from stockpiled sediment or soil; 6) failure to minimize the discharge of pollutants from equipment and vehicle washing, 7) failure to properly store chemicals and construction products, materials, and wastes, 8) failure to store, handle, and dispose of petroleum products, 9) failure to provide an effective means of eliminating the discharge of water from the washout and clean out of concrete, 10) failure to conduct, report, and maintain site self-inspections, 11) failure to submit a complete and accurate Notice of Intent Prior to commencing construction activities, and etc.
