Case summary
On November 21, 2017, the U.S. District Court, Southern District of West Virginia, entered a Consent Decree resolving the liability of Aramark Uniform & Career Apparel, LLC (Aramark) under CERCLA Section 107(a)(2) for past response costs in connection with the Site. Aramark is the successor to a former owner and operator of a laundry and dry cleaning facility located at the Site. Pursuant to the Consent Decree, Aramark will pay $1,595,000 in settlement of past response costs incurred by EPA and DOJ through May 10, 2017, plus accrued interest on all such costs through that date. The Site includes a 6.4-acre parcel (Property) at which laundry and dry cleaning operations were conducted from 1971 to 2006, resulting in the release of perchloroethylene and its chemical degradation products (PCE). From 2010 to approximately January 2017, EPA conducted a removal action at the Site to mitigate PCE contamination of soils at the Property and of a ground water plume migrating north from the Property toward a residential area. Aramark also has agreed to perform ongoing response actions at the Site and to pay EPA oversight costs incurred in overseeing the response actions to be performed by Aramark, pursuant to an Administrative Settlement Agreement and Order on Consent for Removal Response Action (AOC) that was issued on January 19, 2017. The response actions required under the AOC, which Aramark currently is performing, are valued at $4,900,000.
