Case summary
On July 31, 2015, Region III filed a Consent Agreement and Final Order regarding violations of Section 313 of the Emergency Planning and Community Right-to-Know Act of 1986 ( EPCRA ), 42 U.S.C. Section 11023, by Four Guys Stainless Tank & Equipment, Inc. ( Respondent ) at its manufacturing facility located 230 Industrial Park Road, Meyersdale, Pennsylvania 15552 ( Facility ). During calendar year 2011, the Facility processed nickel as part of its manufacturing operations in the production of stainless steel fire trucks. During calendar years 2012 and 2013, the Facility processed chromium as part of its manufacturing operations in the production of stainless steel fire trucks. This CAFO resolves violations discovered by EPA during an October 27, 2014 inspection of Respondent?s Facility to review compliance with EPCRA Section 313 reporting requirements. In reviewing the Facility's manufacturing records, the inspector determined that Respondent had processed more than 25,000 pounds of nickel in calendar year 2011 and more than 25,000 pounds of chromium in calendar years 2012 and 2013 without timely filing a Form R or Form A with both EPA and the Commonwealth of Pennsylvania as required by Section 313 of EPCRA and the associated federal regulations of 40 C.F.R. Part 372. Under the terms of the settlement, Respondent will pay a civil penalty in the amount of $28,623.00 to resolve these violations of EPCRA Section 313 and the associated federal regulations of 40 C.F.R. Part 372.
