The CAFO alleges that Respondent failed to: (1) Issue new individual control mechanisms (?permits?) to two industrial users of the Facility prior to the expiration dates of the old permit; (2) Inspect and sample the effluent from one significant user of the system at least once a year; (3) Conduct monitoring at its Facility that includes quarterly influent, effluent and sludge analysis for all local limits parameters and an annual priority pollutant scan for influent and sludge, as well as submit the analytical results of such monitoring to EPA annually; (4) Adopt a new ordinance establishing its legal authority to enforce EPA?s October 2005 amendments to the federal pretreatment program and amend its enforcement response plan containing detailed procedures indicating how it will investigate and respond to instances of industrial user noncompliance; (5) Publish a list of the 2012 significant non-compliers. These failures constitute a violation Sections 301(a), 402 and 403 of the CWA, 33 U.S.C. ?? 1311(a) and 1342. These violations are associated with the City of DuBois annual pretreatment reports (2010, 2011, 2012, 2013) and were discovered therein. The CAFO provides for the City of DuBois to pay a civil penalty in the amount of $10,000.00.
