Case summary
On March 31, 2015, a Consent Agreement and Final Order (CAFO) between EPA Region III and the U.S. Department of the Navy was filed with the Regional Hearing Clerk. The CAFO resolved alleged violations of the RCRA and the CAA discovered by EPA during a multi-media inspection at Naval Station Norfolk, Norfolk, Virginia from June 20 - 23, 2011. As a federal entity, penalty claims cannot be brought against the Navy for violations of the Clean Water Act, however, prior to the execution of the CAFO, EPA required that the facility address stormwater compliance issues and take steps to prevent discharges of oil and paint to waters at the facility. The settlement requires a payment of $83,900.00. The inspection team was led by members from OECEJ and also included inspectors from the Virginia Department of Environmental Quality and the Virginia Department of Conservation and Recreation.
