Case summary

On March 27, 2015, EPA Region III issued a Final Order to Wal-Mart Stores, Inc. (Walmart), resolving CWA violations of EPA's General Permit for discharges of stormwater associated with construction activities at Walmart's Washington, D.C. construction site located at 5929 Georgia Avenue. During a February 2013 inspection of the Georgia Avenue construction site, EPA found that Walmart failed to maintain perimeter stormwater controls, failed to minimize sediment trackout, and failed to protect stormwater inlets at the construction site, and also failed to update its stormwater pollution prevention plan maintained at the construction site. In the Consent Agreement and Final Order (CAFO) which initiated and resolved this matter, Walmart agreed to pay a $20,000 penalty for the construction permit violations. The CAFO received no comments during the required 40-day public comment period.
