EPA v. WALMART

Final Order No Penalty

Case summary

On February 9, 2015, EPA Region III executed an administrative order on consent (AOC) to Wal-Mart Stores, Inc. (Walmart), resolving CWA violations of EPAs General Permit for discharges of stormwater associated with construction activities at Walmarts Washington, D.C. construction site located at 5929 Georgia Avenue. During a February 2013 inspection of the Georgia Avenue construction site, EPA found that Walmart failed to maintain perimeter stormwater controls, failed to minimize sediment trackout, and failed to protect stormwater inlets at the construction site, and also failed to update its stormwater pollution prevention plan maintained at the construction site. In the AOC, Walmart agreed to take corrective measures immediately to address each of these construction activities and to develop and submit a long term plan to demonstrate continued compliance with the EPA Construction General Permit.
