Case summary

sewer system (MS4) violations.(Docket No. CWA-03-2014-0233) On September 23, 2014, EPA Region III issued a Final Order to the Delaware Department of Transportation (DelDOT) resolving CWA violations of DelDOT�s NPDES Permit for stormwater discharges from MS4s. During an April 2013 inspection, EPA found that DelDOT had failed to ensure that all practicable measures to reduce pollutants from DelDOT maintenance facilities were taken and that all stormwater pollution prevention plans were updated at all of the maintenance facilities, failed to ensure the proper operation of treatment facilities at one of its maintenance facilities, and failed to take timely enforcement of construction activities throughout its MS4 system. In the Consent agreement and Final Order (CAFO) which initiated and resolved this matter, DelDOT agreed to pay a $32, 500 penalty for the MS4 violations. The CAFO received no comments during the required 40-day public comment period.
