Case summary
On August 15, 2014, EPA Region III executed an administrative order on consent (AOC) with the Delaware Department of Transportation (DelDOT) resolving CWA violations of DelDOTs NPDES Permit for stormwater discharges from MS4s. During an April 2013 inspection, EPA had found that DelDOT had failed to ensure that all practicable measures to reduce pollutants from DelDOT maintenance facilities were taken and that all stormwater pollution prevention plans were updated at all of the maintenance facilities, failed to ensure the proper operation of treatment facilities at one of its maintenance facilities, and failed to take timely enforcement of construction activities throughout its MS4 system. In the AOC, DelDOT agreed to take corrective measures to address each of these four categories of MS4 violations and submit to EPA evidence that these corrective measured have been completed.
