Case summary
On September 23, 2014, EPA Region III issued a Final Order to New Castle County resolving CWA violations of the Countys NPDES Permit for stormwater discharges from MS4s. During an April 2013 inspection, EPA found that New Castle County had failed to maintain an accurate list of high risk industrial facilities for periodic inspections and monitoring, and had failed to take appropriate and timely enforcement action at a County owned construction site to minimize runoff into New Castle Countys stormwater collection system. In the Consent agreement and Final Order (CAFO) which initiated and resolved this matter, New Castle County agreed to pay a $17,400 penalty for the MS4 violations. The CAFO received no comments during the required 40-day public comment period.
