Case summary
On August 15, 2014, EPA Region III executed an administrative order on consent (AOC) with New Castle County resolving CWA violations of New Castle Countys NPDES Permit for stormwater discharges from MS4s. During an April 2013 inspection, EPA had found that New Castle County had failed to maintain an accurate list of high risk industrial facilities for periodic inspections and monitoring, and had failed to take appropriate and timely enforcement action at a County owned construction site to minimize runoff into New Castle Countys stormwater collection system. In the AOC, New Castle County agreed to take corrective measures immediately to address each of these two categories of MS4 violations and submit to EPA evidence that these corrective measured have been completed.
