A Consent Agreement and Final Order ( CAFO ) entered into by the U.S. Enviornmental Protection Agency, Region III ( EPA ) and NanoHorizons Inc. ( Respondent ) of Bellefonte, Pennsylvania was filed with Regional Hearing Clerk settling alleged violations of the Federal Insecticide, Fungicide and Rodenticide Act, as amended ( FIFRA ). Subsequently, Respondent developed and implemented a corrective action plan to address the claims, and is certifying in the CAFO that, to the best of its knowledge, all claims, statements and implications made in connection with the distribution or sale of its SmartSilver products are in compliance with FIFRA and EPA's PR Notice 2000-1. This action assesses a penalty for Respondent's past noncompliance in connection with the impermissible claims made for its SmartSilver products. According to the CAFO, Respondent is assessed a penalty in the amount of one thousand five hundred dollars ($1,500) for the alledged violations, Respondent is a Delaware corporation that produces and sells silver additives under the brnad name SmartSilver with a principle place of business located at 270 Rolling Ridge Drive in Bellefonte, Pennsylvania.
