Case summary

On April 15, 2014, EPA issued a CWA Super Consent Agreement and Final Order finalizing a $140,000 penalty settlement with the Respondent, Amerikohl Mining, Inc. for discharging pollutants in excess of multiple NPDES permits at numerous mines throughout Pennsylvania. On March 7, 2012, EPA sent a Section 308 Request for Information to Amerikohl concerning their mining operations in Pennsylvania. Responses to the information request identified numerous violations of NPDES permits. Following additional investigations, a Show Cause letter was sent on March 20, 2013, to initiate settlement discussions. The Respondent and EPA engaged in negotiations on NPDES compliance and penalties for past non-compliance. The negotiations that followed resulted in the referenced CAFO, which resolves 157 NPDES violations at 22 mining operations in Pennsylvania, 18 inactive mines and 4 active mines. In addition, under the CAFO Respondent has to implement a newly created Standard Operating Procedure (SOP) plan submitted to EPA, intended to better ensure future compliance at existing and future mining operations.
