EPA v. PBS COALS, ET. AL. (29 FACILITIES)

Case summary

The United States, on behalf of EPA and the Pennsylvania Department of Environmental Protection (PADEP) entered into a Stipulation and Order (S&O) finalizing a $6.5 million civil penalty settlement for violations of permit conditions contained in numerous National Pollutant Discharge Elimination System (NPDES) permits issued to defendants PBS Coals, Inc.; Croner Inc.; Elk Lick Energy, Inc.; Quecreek Mining, Inc.; And Roxcoal, Inc. (collectively ?Defendants?) under the CWA. The S&O was filed in the Western District of Pennsylvania on September 1, 2016. The United States filed a complaint for the CWA violations against Defendants on April 19, 2016. Under the S&O we have reserved our rights to bring injunctive relief claims arising from the underlying violations in the future.
