D.C. General has not complied with some of the requirements of the CAA, the Code of Federal Regulations, and federally enforceable General and Non-attainment Area Permit and Title V Operating Permit requirements, including failure to perform annual combustion adjustments to minimize formation of carbon monoxide and oxides of nitrogen for three (3) boilers; failure to conduct weekly visible observations or annual visible emission test for three (3) boilers and emergency generators EG-1 through EG-7; failure to obtain construction and operating permits from the District in accordance with 20 DCMR 200, and/or revision of the operating permit (Title V) in accordance with 20 DCMR 300 before initiating construction, installation of equipment which emits or controls air pollutants; failure to maintain log of date and time of operation of Emergency Generators EG-1 through EG-7; failure to sample and test fuel oil for once per quarter (or otherwise demonstrate compliance with the sulfur requirement) for Boilers CU-1 through CU-4 and Emergency Generators EG-1 through EG-7; and failure to keep records of refrigerant purchased and added to appliances normally containing 50 or more pounds of refrigerant pursuant to 40 CFR Paragraph 82.166 for chillers CU-2, CU-4, and CU-5.
