Case summary
On or about May 22, 2013, EPA Region III filed the above-captioned settlement. This Expedited CAFO simultaneously commences and resolves an administrative penalty proceeding against Respondent pursuant to Section 16(a) of the Toxic Substances Control Act (�TSCA�), 15 U.S.C. � 2615(a), for violations of the underlying federal �Lead Based Paint Activities� Rule as set forth at 40 C.F.R. Part 745, Subpart L (�LBPA Rule�). This Expedited CAFO relates to a training course Respondent offered on April 27, 2012. During the relevant time period, Respondent was the �training provider� for the renovator training course listed above. The alleged violations pertain to Respondent�s failure to: 1) have each student at the 4/27/2012 initial renovator course successfully complete the hands-on skills assessment pursuant to 40 C.F.R. � 745.225(c)(7).
