Case summary

On October 7, 2020, Region 3 entered into the first amendment (First Amendment) to a March 4, 2013 RCRA 3008(h) Administrative Order on Consent (AOC) with LSI Corporation (LSI) and Nokia of America Corporation (Nokia) (formerly Alcatel-Lucent USA Inc.). The AOC amendment provides, among other things, that LSI continue to implement corrective measures selected by EPA in the ROD, as modified by four ESDs; that LSI continue to submit monitoring reports until LSI demonstrates no further exceedances of clean-up goals at all points of compliance for a subsequent period of three years; and that LSI may cease implementation of corrective measures if EPA determines that clean-up goals have been achieved. Should LSI fail to adequately perform the work under the AOC and First Amendment, Nokia has agreed to complete the work.
