Case summary
On October 26, 2012, Region 3 filed the above captioned SuperCAFO in settlement of a February 6, 2012 AShow Cause@ letter issued to Respondent for violations of RCRA Subtitle I (pertaining to regulation of underground storage tanks) at its Broad Rock BP gas station Facility located at 2869 Broad Rock Blvd., Richmond, VA. Under the terms of the SuperCAFO, Respondent certifies that it is currently in compliance with Subtitle I of RCRA at the facility in question, and will pay a civil penalty for allegedly failing to: 1) test automatic line leak detectors annually for 5 USTs, and 2) provide the requisite financial assurance in accordance with the Commonwealth of Virginias federally authorized underground storage tank program -- which was authorized by EPA in lieu of the Federal underground storage tank management program.
