Case summary
On September 20, 2012, EPA Region III both filed a Complaint against and finalized an Administrative Consent Agreement and Final Order with Beebe Medical Center, Inc. (Beebe) for a violation of the Oil Pollution Prevention Regulations, which were promulgated under Section 311(j) of the Clean Water Act, as amended (CWA). In the CAFO EPA alleges that Beebe failed to prepare and implement a Spill Prevention Control Countermeasures (SPCC) Plan for its hospital facility located at 424 Savannah Road, in Lewes Delaware, as required by 40 C.F.R. § 112.3. The facility has roughly 48,000 gallons of oil storage capacity and drains stormwater through a stormwater sewer into the Lewes and Rehoboth Canal, which is a navigable-in-fact water of the United States. The settlement was issued pursuant to Section 311(b)(6)(B)(i) of the CWA. Beebe has agreed to a pay Class I civil penalty.
